If he wrote the software while working for the company as part of his work for the company, then they own it. If he wrote the software while working for the company on his own time and not as part of his work for the company, then the matter is less clear, but there's every chance that the company MIGHT at some future stage try to claim ownership, so it might be as well for him to consult a parasite^Wlawyer.
