D'you mean this

    %&program=xelatex
    %&encoding=UTF-8 Unicode

becoming that

    %!TEX TS-program = xelatex
    %!TEX encoding = UTF-8 Unicode

and this too

    %&program=xetex
    %&encoding=UTF-8 Unicode

becoming

    %!TEX TS-program = xetex
    %!TEX encoding = UTF-8 Unicode

I think the former form is still used in the samples and doc.
