But if you looked good, you would see a red asterix (*) next to either the 
subject and/or the comment field after pressing "preview" without anyting to 
preview indicating that one really has to fill in something.

Usability wise maybe. But not codewise. And if it *is* a bug, please submit one 
at http://drupal.org/node/add/project_issue
