I think only Markus Oberhumer himself can really proof if they use his code. I am absolutely sure they do. UPX is such a complex program which uses many tricks and ways to compress the files that this is proof enough that they use it. If they only would use the compression library for compressing something, ok. But they use the UPX overhead program which decides, which sections within a PE file to compress and how to move them within the PE file and to make the compressed PE file work by adjusting the PE header and stuff like that. Such a thing CANNOT just be re-programmed and then it works exactly the same way UPX does. Its not that they are using the same "algorithm/format" - the algorithm or format is what UPX is, so they stole the technology, using the same code or not. Hope you understand my point of view, but in my opinion there is no need for a proof that they really use the UPX source code for doing this. They use the software technology which is copyrighted by the GPL.
