Hmmm. I think you're being a little over-fastidious, given that
you're a few thousand miles away from Flex-ES development and it's
probably one of the things development would not consult you on.

Nevertheless.

I quite likely did say it, early on. That was before it was
suggested as a vehicle for learning about Hercules' sources. It is
actually pretty damn thin in that regard. There's certainly no
corroboration of the most recent assertions here, though I now
understand a little more about UMX than I did - thanks to the time-
stamped change log. "Zwei Fliege mit einer Klappe?"

In all this (necessary, it would appear) detail we're getting away
from the fundamental point. Hercules has an unassailable position
for 'legacy' computing - for those who (like me if I had the time)
would like to study the evolution of IBM's early mainframe OSes.
I've said many times that there's an ABEND0C5 in the MFT 21.8 Master
Scheduler that I'd like to go after if I ever get the time.

Oddly, back when I was a bit-twiddling systems programmer at Barclays
Bank, I _did_ wear a suit. I also debugged object code and had hair
almost to my waist. Still - reading comprehension again.)

But the development of ESA/390 and zArchitecture functionality in
Hercules still interests me. Why? For fun? Pull the other one -
"DrinkorDie" said the same thing and didn't impress the judges at
all.

It's obvious after only an hour or two's research that IBM's licenses
are watertight. There are - and have been - no "disaster recovery"
or "testing" provisions in IBM's agreements. I know - it was my job
to monitor them for the PCMs for almost two decades. The slimy
assertion that the facts are otherwise is a MAJOR issue with the
Hercules fraternity. Use of any licensed OS (or other) code under
Hercules requires IBM's explicit permission - which has to be
sought. I can find no trace even of any intent to do this - ever -
much less any attempt.

And yet the project continues unabated, with prima facia pirates
(thieves, by their proper name) receiving automatic assistance on the
main Hercules mailing list.

(BTW - if you want your disclaimer to have the faintest hope in hell,
you have to place it BEFORE the useful little tip that helps them get
VSE or OS/390 or z/OS running illegally. Courts read sequentially
from the start to the end of the document. You cannot apply a
disclaimer to information you've already imparted - your only chance
of success is to suggest that the reader not proceed if not entitled
and place your hint AFTER the disclaimer. BTDT. But you won't
believe me again, of course.)

I fail to understand what the project is currently trying to achieve,
and I mean that quite literally. On the one hand, there's general
jubilation at sneaking under the wire and ripping something off IBM,
and on the other hand there's the desire that IBM (for no discernable
return) should grant a hobbyist license. Do you think your cavalier
attitude to their intellectual property will in some way generate a
warm and complaisant feeling within their breasts?

And if you feel tempted to reach for the 'Open Source' crutch, you
need to ask yourself four questions:

a) Whose idea was IBM's Linux commitment?

b) Was this the same person who came up with eLiza and the lizard?

c) Seen his name lately?

d) What happened to Eliza (and the lizard) yesterday?
