Group licenses are no longer available to anyone under any
circumstances except continuance of a license signed before 1 January
2000. See Announcement Letter 998-295:

The "charged at maximum group if unknown" is another piece of
Hercules FUD - the arrangement was grandfathered to a 200MSUs cap on
23 Match 1995 by Announcement Letter 395-045:

As you will see, the 200MSUs charge was defined for calculation
purposes as IMLC. Since the withdrawal of IMLC there has been no way
to calculate the exact level (in $$$) that a 200 MSUs system would
have - IBM has changed price levels numerous times since then, and
converted to a new SAP/R3 system - and so this arrangement died with
IMLC on 1 January 2000. No succeeding arrangements have been defined
for PSLC or (V)WLC - therefore the option is no longer available.

No emulation systems are carried on schedules for reasons with which
you and I are familiar. That leaves the PWD option, the ESL option,
and the GEN Letter option.

We know - from a clear statement on the Partnerworld web site - that
PWD is only available under Flex-ES.

It's obvious - from the open sourse nature of Hercules - that dongle
technology is inapplicable and therefore ESL is not available.

I know - because I helped to write the damn thing - that Hercules
does not appear on the current GEN Letter, which was originally
produced for the x430.

As if this were not enough, IBM has started sending: "IBM has taken a
business decision not to license its commercial software on this
platform" to anyone who enquires about licensing under Hercules.

I'm not saying that (e.g.) z/OS will never be licensed under
Hercules. I _AM_ saying that it is currently impossible - it is not
a matter of money but of policy - and that I see no effort being made
by anyone to change this position. I am told there is an RFA in
circulation about pricing under emulators, but I can find no trace of
the Hercules project participating in it.
