You could be right. I might be confusing him with somebody else.

Point is, while I personally cannot recall anymore who it was (maybe
someone else can, I don't know. I just know I can't anymore), I *do*
seem to remember there was at least one person who claimed to have
one. (I could be wrong of course, but I don't think I am).

Now whether that person was, at the time, telling the truth or not, I
don't know (nor do I really care). The point is that unless my memory
is failing me there *IS* at least one person who either has, or at
one time had, a license to run a relatively modern (I believe) IBM
operating system under Hercules.

Thus, given that this person was obviously able to obtain a license
(i.e. that there exists at least ONE person who was able to persuade
IBM to give them a license), I personally don't feel it's
unreasonable to assume that might well be others too (thus the use of
the word "some").

Now before Elmo and/or Elmer can jump in and ask the obvious
question:

"Well then why don't they make themselves know us?!",

allow me to try and answer it the best I can:

"Gee Elm(o/e)r, I don't know.
Why don't you go and ask them?"

Finally, as has been stated MANY time before, it is NOT *OUR*
responsibility to ensure our users are abiding to the terms of THEIR
licenses with *IBM*. That is THEIR responsibility, not ours.
Hercules's purpose and usefulness is *NOT* limited to running *ONLY*
IBM's latest and greatest S/390 and zArchitecture operating systems
(as Mr. FUD wants others to believe)[1]. Just because it's *able* to
do that, doesn't mean that is it's only use/purpose.

Thus, in my own personal opinion, this whole "legality" issue
regarding IBM software licensing with respect to Hercules is silly.
Such issues lie within the province of "user responsibility" and not
"Hercules developers responsibility."

[1] And to head off yet ANOTHER question that I'm sure they'll end up
(RE-)asking again (for the umpteenth time) (i.e. "Then why was that
capability added to Hercules if not to allow one to be able to do
that?"), all I can say is what I believe Jay has already said (also
many times before): for the shear hell of it (paraphrased). I.e.
because we could. Because doing that kind of shit is fun. We're
programmers with a mainframe background and we like programming and
doing such intellectually challenging things. (i.e. for the pure
"hack value" as I believe Jay said).

Now if that's not a good enough answer for the FUD brothers, there's
not much I or anyone else can do about that. That's the answer AFAIK
and I suspect that's the only answer anyone will likely get for such
a question.

(The only reason I can think of as to WHY someone might find such an
answer to be unacceptable to them is, more than likely IMO, because
they are not, not ever have been, a programmer. More than likely
they're "suits". Software engineers love to build things (programs)
and tinker with them. "Suits" on the other hand like to try and find
reasons why it's not humanly/legally possible build what we engineers
have already built.

It's truly sad if you ask me.
