Yeah, it would. So take it.

One-off - you and Jay have a marvellous opportunity to demonstrate
whether you're honest or a pair of lying, thieving, devious cheats.

Dead straightforward:

a) Name your public source for all of the SIE implementation in
Hercules. Is this so hard - it's supposed to be such a model of
openness, after all? Or does "open source" only refer to the code
and not where you got it from?

b) Name just _ONE_ legal commercial licensee of a current IBM
operating system under Hercules. Or - failing that - get just _ONE_
IBMer to contact me via Analyst Relations (Tiiu Mayer for preference -
she has a phenomenal reputation in the industry, but Bill Reed,
Ludovic Leforestier, or even Dan Colby himself).

One of the classic responses is: "IBM have never complained".

No. They don't - until after the handcuffs are on. Stupidity
sometimes knows no boundaries.
