update: for some reason this card suddenly started working. i can
associate to an AP and move data just fine.
kismet is still a problem. when it changes channels it dies. im not sure
if this is a kismet problem or a driver problem

it will run for a while when channel hopping is turned off.
also when kismet is started, then stopped, then started again it is unable
to find eth1 when eth1 is in monitor mode.
