**************************************** For more information/links, see http://goanet.netfirms.com **************************************** Dear Netizens I am interested in contacting one Mr. Joaquim Clemente Portuguese national of Indian origin and Ms. Clementina Clemente Zimbabwian national who are now believed to be residing in Ontario Canada. The matter pertains to sale of their property at Borda Margao Goa surveyed under Chalta Nos 72 PTS 152 of City Survey Margao Goa, for Rs.80,000 to one Jayant Vinayak Naik Proprietor of M/s Delta Real Estate of Comba Margao Goa PURCHASER. There is only an Agreement to Sell dated 20.8.1987 but no Deed of Sale yet executed with the said PURCHASER The Power of Attorney holder of the original owners as per the Agreement is one Ms. Yvonne Celine Neves Andrade resident of Ambajim Fatorda Goa . The development done viz; construction of Apartments ) on this part of the property which is now amalgamated to another property PTS 152 Chalta 61 & 62 was done without the sanad of Conversion ( converting of land from agriculture to non agriculture N/A). Hence vide an order dated 5.9.1996 from the Court of Dy Collector and SDO Margao the PURCHASER was directed to regularise the same. This was regularised not by the original owner or the PoA holder BUT by the PURCHASER without holding a Power of Attorney to that effect. There is no Reserve Bank of India Clearance under FERA (Roreign Exchange Regulation Act ) for executing the Agreement to sell dated 20.8.1987 niether is there an Income Tax Clearance Certificate provided by the original owners . In the absence of these vital documents and the Purchaser acting on behalf of the owners WITHOUT being a Power of Attorney holder or having the Deed of Sale executed is irregular and has been referred to the Collector South Goa and the Dept of Vigilance. The residents of the two buildings Apartments have difficulty regarding the survey and demarcation of the property as a result laying of water pipeline is affected and the Buildings are not assessed to House Tax till date even the Occupancy Certificate is under dispute as the original licence for construction pertains to the onwer of PTS 152 Chalta 61 & 62 whose plot is amalgamated to PTS 152 Chalta 72 Could anyone provide us the residence or email or Fax or telephone nos of Mr. Joaquim Clemente and Ms Clementina Clemente to enable the purchasers of the over twenty four flat have a CLEAR CLEAN & MARKETABLE TITLE.
